The following terms and conditions
(“Conditions”), together with the relevant
information set out in this brochure, will be
incorporated in your contract with EIH Limited for
the holiday you book and shall be binding on both
the parties, i.e. EIH Limited (“EIH”) and the Guest
(“you”). Please read the Terms & Conditions
carefully before you book.

|
1. BOOKING
- Please plan your holiday
carefully and let us know your
special requirements or requests
before booking.
- In planning your departure date
please take into consideration that
certain religious festivities may
temporarily disrupt your holiday and
may result in a reduction of
facilities or entertainment.
- To secure your booking, you
should complete and sign the
Booking Form
(available at
www.oberoihotels.com/indiainluxury)
and send it to EIH with a deposit of
50% of the total holiday cost per
person or as otherwise advised by
EIH.
- Payment of the balance should be
made not later than 4 weeks before
the proposed arrival date in India.
If you are booking within 4 weeks of
departure, then full payment is
required in advance with your
booking. Payment can be made by most
major credit cards or by electronic
bank transfer in favor of “EIH
Limited”.
- If for any reason your booking
is not accepted your deposit will be
returned.
- Please furnish your and your
party member’s full name
(as per passport) and passport
number, date of issue/expiry
together with a copy of the
passport with photo /
summary page at the time of booking.
It is recommended that children
travel on full passports.
- EIH will not provide any visa
services. Please note that obtaining
Indian visas for each member of your
party is your responsibility.
You should check with the Indian
embassy or consular office in your
country to determine if you require
a visa to travel to India and obtain
the same if required. Any
cancellation of booking on this
account shall be at your cost as per
the terms provided herein.
- If you or any member of your
party suffers from a disability or
other medical condition please let
us know in writing with specific
details before you book. EIH will
endeavor to assist you to choose a
holiday that will meet your
requirements.
- You are advised to consult your
doctor for advice on precautions
that you need to take before
traveling such as vaccinations,
medications etc) before you book and
in good time before your departure.
- EIH will endeavor to accommodate
your request but cannot guarantee
the same. Special requests do not
form a term of the contract.

2. CONFIRMATION & CONTRACT
- When you make a booking with EIH
you are confirming that you
understand and accept the terms and
Conditions on behalf of yourself and
all the members of your party
- When your booking has been
accepted by EIH, EIH will issue a
Confirmation Note to you confirming
your booking. Until a Confirmation
Note is issued EIH has no booking
commitment or obligation. It
is important that you carefully
check the Confirmation Note details
as soon as you receive it and in the
event of any discrepancy please
contact EIH immediately.
- On the date on which EIH issues
a Confirmation Note for your booking
a legally enforceable contract will
come into existence between “EIH
Limited” and you for EIH to arrange
your holiday in accordance with the
details set on in the Confirmation
Note (“Contract”).
- The Contract includes all of the
Terms & Conditions as well as any
special conditions listed in the
Confirmation Note.
- The Contract shall be subject to
and governed exclusively by the laws
of India and the courts at Delhi
shall have exclusive jurisdiction.
- If your booking is made through
a travel agent, EIH will address all
communications to your travel agent,
who will act as an agent for you in
all communications with you. All
monies paid by you to the travel
agent under or in contemplation of
the Contract shall be held by the
travel agent in trust for EIH until
such monies are actually paid to EIH.

3. AMENDMENTS & CANCELLATION
- If you wish to cancel or amend
the booking, the signatory to the
Booking Form must give written
notice to EIH by email, facsimile or
registered letter at the following

- A properly notified cancellation
shall be effective on the date that
it is received by EIH unless the day
of receipt is not a business day in
Delhi in which case the cancellation
shall be effective on the next
following business day.
- The following cancellation
charges will be payable, depending
upon the day on which the notice of
cancellation is received by EIH:
- If
notice is given more than 60
days before the departure date
the deposit will be fully
refunded;
- If
notice is given more than 30
days but less than 60 days
before the departure date one
half (50%) of all moneys paid
will be refunded and the balance
will be absolutely forfeited;
- If
notice is given less than 30
days before the departure date
no refund will be given and all
moneys paid / payable will be
absolutely forfeited;

Amendments will be permitted
only based on availability and
extra charges as applicable.
Please note that some airlines treat
a change of passenger name as
cancellation for which a
cancellation fee up to 100% can be
levied. Any amendments to dates of
travel may attract additional
charges.
- Great care is taken to ensure
that the description and prices
specified are accurate at the time
of publication. However EIH
reserves the right to make any
change that it deems necessary ,
including prices, in which case EIH
will advise / notify any such
change before accepting your booking
or as soon as possible in case the
booking has been made.
- Once a Confirmation Note has
been issued, EIH makes every effort
to operate the holiday, the subject
of the Contract, as advertised.
However, as the arrangements are
planned and made a long time in
advance of the holiday using
independent suppliers such as hotel
owners, airlines, local transport
operators and guides etc, over whom
EIH has no direct control It is not
always possible for EIH to control
all elements of the holiday whereby
advertised facilities can sometimes
become unavailable at short notice
due to inclement weather conditions,
lack of demand or emergency repair
works.
In very rare circumstances, EIH may
have to modify a holiday before
departure. Most such changes are
minor. However, if EIH considers
that they constitute a material
change EIH will notify you or your
travel agent as the case may be as
soon as reasonably practicable. A
material change includes a change of
flight time by more than 12 hours, a
change of airport (except between
airports serving the same city), a
change of destination or a change to
a lower standard accommodation,
and/or price.
- EIH is not liable in the event
your holiday is adversely affected
in any way by “force majeure” events
or other unusual and unforeseeable
events or circumstances beyond the
control of EIH or its suppliers.

4. POLICY & PRICE ADJUSTMENTS
- All prices are quoted and
payable in INR.
- EIH is not responsible for any
fluctuation in the exchange rate for
conversion of your currency into INR
and any resultant increase in the
price of your holiday.
- EIH is not under any obligation
to provide a breakdown of the costs
involved in your holiday.
- EIH reserves the right to notify
an increase in the brochure or
advertised price before accepting
any booking.
- The price of your holiday travel
arrangements may change at short
notice due to changes in
transportation costs such as:

Aviation fuel supplements ;
-
Fees chargeable for services
such as landing taxes or
embarkation or disembarkation
fees at airports and any
other similar charges ,
-
Scheduled airfare increases and
any other airline cost changes
made at short notice may
increase the price of your
travel after you have booked.
Any additional payment required
must be made forthwith on
written notification and request
by EIH.
- Prices quoted by EIH are
inclusive of all Indian government
taxes at the time of quotation
including without limitation value
added taxes. If after the issue of a
quotation or Confirmation Note
applicable Indian government taxes
are increased or new taxes imposed
then the price payable by you shall
be adjusted to reflect such
increased taxes and any additional
payment required must be made
forthwith on written notification
and request by EIH.
- EIH reserves the right to change
prices at any time due to any other
unforeseen circumstances or factors
beyond control of EIH. However, EIH
shall notify the change as soon as
practicable.
- Any additional excursion or
activities booked by you during your
holiday shall be charged extra.
- You shall be responsible for
payment of any other unspecified
charges.

5. EIH RESPONSIBILITY
- EIH applies reasonable checks to
ensure that those involved in the
preparation and provision of your
holiday like the various suppliers
maintain the appropriate standards.
- The description and information
provided and opinions expressed in
this brochure by EIH in respect of
the airlines, hotels and other
suppliers whose services are used
are given in good faith, based on
the latest information available at
the time of printing.
- Suppliers (such as accommodation
providers, transport providers and
guides) have their own contract /
supply conditions, and such
conditions are binding between you
and the supplier. Some of these
conditions may limit or remove the
relevant supplier's liability to
you. EIH is not liable and does not
indemnify for any willful or
negligent act or omission of any
third party supplier to you of goods
or services under or pursuant to the
Contract. You can obtain
copies of suppliers conditions from
the relevant suppliers.
- Operational decisions may be
taken by air carriers and airports
resulting in delays, diversions or
rescheduling. EIH has no control
over such decisions, and is
therefore unable to accept
responsibility for them.

6. EIH LIABILITY
- Subject to these Conditions and
in particular paragraphs (b) and (c)
of this Clause 6,
EIH will accept responsibility if
due to any willful omission of EIH:
-
Your holiday is cut short or not
of a reasonable standard;
- If
an illness, injury or death is
caused due to lack of any
facility or service EIH will not
be liable for and to the extent
that such failure, death or
injury is caused due any act of
omission or commission by you or
a member of your group or a
third party supplier or by
unforeseen circumstances which
with all due care could not have
been anticipated or avoided.
- For claims that do not involve
personal injury, illness or death
the maximum amount of the liability
of EIH is limited to the
proportionate part price of the
affected person paid for the
holiday, exclusive of government
taxes and other charges.
- In case of injury, illness or
death during or as a result of any
transport arranged by EIH as part of
your holiday the liability of EIH to
pay compensation and / or the amount
of compensation shall be subject to
terms and conditions of the
transport carrier applicable to you
and limited in accordance with the
liability of the relevant transport
carrier.

7. INSURANCE
- It is strongly recommended that
you obtain comprehensive and
adequate travel insurance
cover and that it is adequate for
your needs, including cover for
personal injury, death, medical and
repatriation costs, together with
cover for loss of baggage and
valuables, personal liability,
delay, cancellation, curtailment,
missed departure and legal expenses.

8. SUPPLY CONDITIONS - AIRLINES
& OTHER SUPPLIERS
- The supply terms and conditions
of all third party suppliers
(including without limitation
airlines, hotels and guides) will
apply to the provision of goods or
services provided by those suppliers
to you.
- Such terms and conditions may be
subject to special conditions
including international conventions
which exclude, limit and/or restrict
the suppliers' liability.
- Transport schedules are provided
by the airline carrier concerned and
are subject to such matters as
weather conditions, maintenance
requirements, the ability of
passengers to check-in on time and,
in the case of flights, to air
traffic control restrictions.
Accordingly, the time of flights and
other forms of transport are
estimates only and cannot be
guaranteed.
- All Indian airlines and most
airports have introduced a smoking
ban on all of their flights.

9. DATA PROTECTION
- In order to process your booking
and to ensure that your travel
arrangements run smoothly and meet
your requirements, we need to use
the information you provide such as
your name, address, any special
needs / dietary requirements etc.
- EIH takes full responsibility
for ensuring that proper security
measures are in place to protect
your information. EIH may pass the
information on to the relevant
suppliers such as airlines, hotels,
transport companies and so on. The
information may also be provided to
security or credit checking
companies, public authorities such
as customs and immigration if
required by them, or as required by
law.
- In making a booking, you consent
to this information being passed on
to the relevant persons. Please note
that where information is also held
by your travel agent, this is
subject to your agent’s own data
protection policy.

this brochure are offered to prospective
guests by EIH Limited, a company
organized and existing under the laws of
India, whose principal office is located

INDIA.
